Terms of Service

These Terms of Service govern access to and use of the MAIA.AI service, published by MAIA SOLUTION, a French SAS whose registered office is located in Avolsheim (France).

By creating an account or using the service, you acknowledge that you have read these terms and accept them without reservation, on behalf of the professional organisation you represent. As the service is intended for professionals and businesses acting within their commercial activity, you declare that you have the legal capacity to bind that organisation.

If you do not accept all or part of these terms, you must refrain from using the service. These Terms of Service are completed, where applicable, by the Terms and Conditions of Sale and the Privacy Policy.

MAIA.AI is an AI-based voice phone assistant intended for professionals and businesses. It can in particular handle incoming calls, answer common requests and pass on information useful to your activity.

Setup includes an onboarding phase during which the MAIA SOLUTION team configures the agent on a tailored basis according to your needs, allow approximately one week. The service is provided in hosted mode (SaaS), accessible through a subscription.

MAIA SOLUTION develops the service on an ongoing basis and reserves the right to modify, suspend or evolve its features in order to improve its quality, security or compliance. As the assistant relies on artificial intelligence technologies, its responses may include a margin of imprecision, and the service is provided in the state of the art at the date of subscription.

Access to the client and administrator areas is carried out using strictly personal and confidential credentials. You are solely responsible for keeping and protecting these credentials.

Any action carried out from your account is deemed to be performed under your responsibility. You undertake to inform MAIA SOLUTION without delay of any unauthorised use or any security breach of which you become aware.

You undertake to provide accurate information when creating your account and to keep it up to date. MAIA SOLUTION cannot be held responsible for the consequences of credentials that are shared, lost or misappropriated due to a lack of diligence on your part.

You undertake to use MAIA.AI in compliance with applicable laws and regulations, as well as with the rights of third parties. The service must be used as part of a lawful professional use consistent with its purpose.

The following are notably prohibited:

• any fraudulent or unlawful use, or any use contrary to public order and morality;
• any attempt to disrupt, circumvent or compromise the security or integrity of the service;
• any use infringing the intellectual property rights of MAIA SOLUTION or of third parties;
• reselling or making the service available to third parties without prior written authorisation.

In the event of a breach, MAIA SOLUTION may suspend or terminate access to the service, without prejudice to any action seeking to remedy the harm suffered.

Access to the MAIA.AI service is subject to a paid subscription, monthly or annual depending on the chosen plan. The applicable rates are shown on the Pricing page of the site.

Payment is made according to the frequency of your plan. The detailed financial terms, the billing arrangements and the consequences of non-payment are set out in the Terms and Conditions of Sale, which complement these Terms of Service on commercial matters.

You may cancel your subscription under the conditions set out by your plan and by the Terms and Conditions of Sale, from your client area or by contacting support.

MAIA SOLUTION may suspend or terminate access to the service as of right in the event of a serious breach of these terms, in particular abusive use, non-payment or harm to the security of the service, after a formal notice has remained without effect except in urgent cases.

Termination results in the cessation of access to the service. Data belonging to you is processed in accordance with the Privacy Policy and with statutory retention obligations.

MAIA SOLUTION is bound by a best-efforts obligation and applies all reasonable diligence to ensure the quality and continuity of the service.

As the service relies on artificial intelligence and on telecommunications networks, you acknowledge that the assistant may not respond comprehensively or accurately to every situation, and that it is your responsibility to keep appropriate handling channels for sensitive or urgent requests.

To the extent permitted by law, MAIA SOLUTION cannot be held responsible for indirect damages, such as loss of revenue, loss of customers or commercial harm. The liability of MAIA SOLUTION, on all grounds combined, is limited to the amounts actually paid for the subscription during the twelve months preceding the triggering event. Nothing in these terms limits liability in the event of gross negligence, wilful misconduct or personal injury.

MAIA SOLUTION reserves the right to modify these Terms of Service at any time, in particular to take account of changes to the service, to regulations or to industry practices.

Substantial changes are brought to your attention by an appropriate means, for example by email or via your client area. Continuing to use the service after the new terms come into force constitutes acceptance of them. These Terms of Service are governed by French law.
